New Classification System for Construction Companies Proposed by the Ministry of Development

The Ministry of Development has recently published a draft order introducing a new classification system for construction companies based on their technical capacity, available resources, and experience in similar projects. The measure aims to increase transparency in public procurement and promote professionalization within the sector.

The new classification proposes four main categories—micro, medium, large, and complex—determined by a composite score that includes turnover, qualified personnel, equipment, and the track record of completed contracts. Companies will be required to obtain a technical competence certificate, which must be renewed annually.

Contracting authorities will be allowed to specify, in procurement documentation, that economic operators must fall within a particular class according to the complexity of the works. This is intended to prevent major infrastructure contracts from being awarded to companies without proven capacity.

Implementation of the order will involve the creation of a public database managed by the State Inspectorate for Construction, and the classification will be linked to the national procurement system (SEAP).

Industry associations support the measure but are calling for clarifications on the criteria and safeguards against unnecessary bureaucracy. A public consultation is expected before the measure is officially adopted.
