
FIDIC contracts (International Federation of Consulting Engineers) are increasingly used in infrastructure projects in Romania, particularly those financed with European funds. They provide a standardized, internationally recognized framework for managing the relationship between the client, contractor, and engineer.
The main advantage is procedural clarity. FIDIC defines responsibilities, payment mechanisms, variation management, and dispute resolution. This reduces contractual ambiguities and facilitates the implementation of complex projects.
However, application in Romania presents challenges. Adapting to national legislation and interpreting clauses can create differences between theory and practice. Additionally, the lack of experience among some stakeholders may lead to a formal rather than functional use of the contracts.
Another risk is related to claims management. Without thorough documentation and effective control, additional costs can escalate rapidly.
In practice, the success of using FIDIC depends less on the contract itself and more on project management capability. Technical expertise, contractual discipline, and effective communication between parties are critical elements.
