Amendments to Romania’s Construction Law: Shorter Deadlines and Stricter Requirements

On September 10, 2025, amendments to Law No. 50/1991 on the authorization of construction works were published in the Official Gazette, through Law No. 236/2025. The new legal provisions introduce updated deadlines and obligations for both authorities and investors.

Key changes include the reduction of the deadline for issuing a building permit from 30 to 20 working days, the mandatory online publication of urban planning documentation, and the inclusion of the environmental permit as a compulsory prerequisite for major infrastructure projects.

The law also clarifies the regime of temporary constructions and establishes additional conditions for authorizing works in protected areas or zones with high seismic risk. Non-compliance with the new provisions will result in fines ranging from 5,000 to 50,000 lei, applicable to both individuals and legal entities.

The Ministry of Development announced that, by the end of October, it will publish an implementation guide on its official website (mdrap.ro) to assist local authorities and investors in applying the new regulations.
