New funds for the systematic registration of properties

The Ministry of Regional Development and Public Administration (MDLPA) informs that the increase in the amounts allocated for the systematic registration works of properties contracted by local authorities at the cadastral sector level and the allocation of budgetary funds for systematic registration works in a minimum of three administrative-territorial units (UAT) from each county, nominated by county councils, are two of the new provisions of Law no. 7/1996 on cadastre and real estate publicity, published in the Official Gazette of Romania No. 25/11.01.2024.

According to the amendments to the Law on cadastre and real estate publicity, the amounts granted for systematic registration works contracted by local authorities at the cadastral sector level are increased from 84 lei + VAT/land book to 109 lei + VAT/land book.

At the same time, funds are provided for carrying out systematic registration works within the National Cadastre and Land Book Program (PNCCF) for a minimum of three UATs within each county, nominated by county councils.

Another modification of the normative act allows the financing, through PNCCF, of works related to the preparation of parcel plans, coordinated by local commissions for the restitution of land properties.

In the case of non-agricultural land subject to land fund laws, where the measured area is greater than the one inscribed in the property deeds, the difference in area will be registered with the mention "unidentified owner" and remains in the reserve of the local land fund commission.

The provider of the respective systematic registration work will be remunerated with 50% of the unit price, namely per hectare or property.

The new provisions allow for the acceleration of the systematic registration procedure of properties by eliminating the requirement for the mayor's countersignature of the technical documents of systematic cadastre, as well as by simplifying the norms regarding the registration of possession in the land book.

Moreover, the amendments to the Law on cadastre and real estate publicity clarify the status of institutions subordinate to the National Agency for Cadastre and Land Publicity (ANCPI), namely the cadastre and real estate publicity offices (OCPI), the territorial offices, and the function of the coordinating registrar.

The normative act establishes the obligation of a unified practice in real estate advertising at the national level and clarifies the norms regarding the registration of condominiums. The new provisions will come into effect three days after being published in the Official Gazette.
